Services may be modified, expanded, suspended, or discontinued at any time.

Users may upload:

• •Videos
• •Audio
• •Text prompts
• •Creative assets
• •Other content

You retain ownership of content you upload. By submitting content, you grant Selfimoji a limited, non-exclusive, worldwide license to host, process, reproduce, modify, and use such content solely for the purpose of operating, maintaining, improving, and providing the Services.

The Services may generate:

• •Videos
• •Stickers
• •Emojis
• •Advertisements
• •Creative assets
• •Other outputs

Generated content is produced through AI systems.

Selfimoji does not use your uploaded content, facial images, or generated outputs to train third-party AI models without your explicit consent.

Selfimoji does not guarantee:

• •Accuracy
• •Reliability
• •Suitability
• •Commercial viability
• •Legal compliance of generated outputs

Users are responsible for reviewing generated content before use or distribution.

You agree not to:

• •Violate any law or regulation
• •Infringe intellectual property rights
• •Upload content you do not have permission to use
• •Impersonate another person without authorization
• •Harass, abuse, or harm others
• •Upload unlawful or fraudulent content
• •Circumvent security mechanisms
• •Reverse engineer the Services
• •Interfere with platform operation

Selfimoji may suspend, restrict, or terminate access for violations of these Terms.

Artificial intelligence systems may produce unexpected, inaccurate, incomplete, or inappropriate outputs. Generated content may not reflect factual information.

Users remain solely responsible for how generated content is used, shared, published, distributed, or relied upon.

The Services may provide access to actors, templates, scenes, creative assets, and related content. Such assets remain subject to any applicable usage restrictions and intellectual property rights.

Users may not claim ownership of assets provided by Selfimoji unless expressly authorized.

The Services may offer:

• •Subscription plans
• •Premium features
• •One-time purchases

Where purchases are made through Apple App Store or Google Play:

• •Billing is handled by the applicable platform
• •Renewals may occur automatically unless cancelled
• •Refunds are governed by the applicable platform provider's policies

The following terms apply to your use of the Services through Apple platforms, including the Apple App Store and Apple devices.

a. Parties

These Terms are entered into between you and Selfimoji AI Inc. only. Apple Inc. is not a party to these Terms and is not responsible for the Services or their content.

b. Scope of License

The license granted to you for the Selfimoji application is limited to a non-transferable license to use the application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

c. Maintenance and Support

Selfimoji AI Inc. is solely responsible for providing any maintenance and support services with respect to the Services. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Services.

d. Warranty

Apple has no warranty obligation with respect to the Services. To the extent that any warranty applies, Selfimoji AI Inc. is solely responsible for such warranty obligations.

e. Product Claims

Selfimoji AI Inc., not Apple, is responsible for addressing any claims by you or any third party relating to the Services, including product liability claims, claims that the Services fail to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

f. Intellectual Property Claims

In the event of any third-party claim that the Services infringe that third party's intellectual property rights, Selfimoji AI Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

g. Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

h. Export Compliance

You represent and warrant that you are not located in a country subject to a United States Government embargo or designated as a terrorist supporting country, and that you are not listed on any United States Government list of prohibited or restricted parties.

The Services, software, branding, logos, designs, interfaces, features, and related materials are owned by Selfimoji AI Inc. or its licensors and are protected by applicable intellectual property laws. Except as expressly permitted, no rights are granted to users.

If you believe content available through the Services infringes your intellectual property rights, please contact info@selfimoji.ai with sufficient information to investigate the claim. Selfimoji reserves the right to remove content and take appropriate action where warranted.

We may suspend or terminate access to the Services at any time if:

• •Fraudulent activity is suspected
• •Security concerns arise
• •Required by law

Termination may result in removal of content, access restrictions, or account closure.

We encourage you to contact us first at info@selfimoji.ai to attempt to resolve any dispute informally before initiating formal proceedings.

If a dispute cannot be resolved informally, it shall be submitted to the courts of competent jurisdiction in Québec, Canada, in accordance with Section 21 of these Terms.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELFIMOJI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY.

APPLE MAKES NO WARRANTIES WITH RESPECT TO THE SERVICES AND ASSUMES NO WARRANTY OBLIGATIONS IN CONNECTION WITH THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELFIMOJI AI INC., ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND PARTNERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICES.

You agree to defend, indemnify, and hold harmless Selfimoji AI Inc. from claims, liabilities, damages, losses, and expenses arising from:

• •Your violation of these Terms
• •Your violation of applicable laws or third-party rights

We may update these Terms from time to time. Updated versions will be posted at https://selfimoji.ai/terms. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

These Terms shall be governed by and interpreted in accordance with the laws of Québec and the applicable laws of Canada, without regard to conflict-of-law principles.

Selfimoji AI Inc. operates in compliance with the Act respecting the protection of personal information in the private sector (Québec Law 25) and the Personal Information Protection and Electronic Documents Act (PIPEDA), as applicable.

Nothing in these Terms limits or excludes any rights you may have under the Consumer Protection Act (Québec) or other mandatory provisions of Québec or Canadian law.
